BUCKS COUNTY, PENNSYLVANIA
AN ORDINANCE AMENDING THE CODE OF NORTHAMPTON TOWNSHIP, SPECIFICALLY CHAPTER 27, KNOWN AS THE NORTHAMPTON TOWNSHIP ZONING ORDINANCE, FOR THE PURPOSE OF
AMENDING SECTIONS RELATED TO FLAG LOTS
NOW, THEREFORE, BE IT ENACTED and ORDAINED by the Board of Supervisors of Northampton Township as follows:
SECTION 1. PART 11, Supplemental Regulations, Flag Lots., ishereby amended to modify §27-1119.2. as follows:
2. In all cases, the applicant must demonstrate that the following site conditions exist:
B. The proposed design should be in the best interest of the community, considering health, safety and/or general welfare issues.
Sections §27-1119.2.A. and §27-1119.2.C. through G. shall remain as written.
SECTION 2. PART 11, Supplemental Regulations, Flag Lots., ishereby amended to modify §27-1119.3. as follows:
3. Sketch plan submissions are encouraged for review by the Township staff, consultants, and Township Planning Commission to review in accordance with all pertinent design requirements specified by the Northampton Township Code.
SECTION 3. PART 11, Supplemental Regulations, Flag Lots., ishereby amended to modify §27-1119.4. as follows:
4. The subdivision shall be designed in accordance with the following requirements:
Sections §27-1119.4.A. through J. and §27-1119.5. shall remain as written.
SECTION 4. SEVERABILITY.
In the event that any section, sentence, clause, phrase or word of this ordinance shall be declared illegal, invalid or unconstitutional by any Court of competent jurisdiction, such declaration shall not prevent or otherwise foreclose enforcement of any of the remaining portions of this ordinance.
SECTION 5. REPEALER.
All ordinances or parts of ordinances inconsistent herewith or in conflict with any of the specific terms enacted hereby, to the extent of said inconsistencies or conflicts, are hereby specifically repealed.
