PUBLIC NOTICE: Zoning Hearing Board to Meet via Zoom Monday, June 8, 2020 at 9:00 AM

 

PLEASE TAKE NOTICE that the Northampton Township Zoning Hearing Board will hold a public hearing through the use of an authorized telecommunications device on Monday, June 8, 2020 at 9:00 AM.  The telecommunications device being utilized for this public hearing is Zoom meetings platform.  Visit www.northamptontownship.org to view the agenda and INSTRUCTIONS on how to participate in the public hearing either through the Zoom meetings platform or by submitting written comments or questions to Northampton Township through regular mail or to the email address below.  If you have any questions prior to the meeting, please contact Mike Solomon, Director of Planning and Zoning at 215-355-3883 or by email at msolomon@nhtwp.org.  The following applications will be considered:  

 

1.         Case No. 2020-10, the application of Ivyland Investments, L.P., for the property located at 76 Louise Drive, Ivyland, Northampton Township, Bucks County, Pennsylvania, identified as Tax Map Parcel No. 31-1-4-19.  The property is located in the I-1, Planned Industrial/Office, zoning district.  The property is in the Northampton Township Business & Technology Center.  The property is improved with a non-residential building, parking areas and related improvements.  The building contains a combination of space devoted to office, manufacturing and warehouse uses.  The Applicant proposes two (2) additions to the existing building that will expand the warehouse and manufacturing uses.  The Applicant seeks a variance from Northampton Township Zoning Ordinance §27-603.2.E to permit a building coverage ratio of 31%, where the maximum building coverage ratio permitted by right is 30%.

2.         Case No. 2020-11, the application of The Physical Development Center, LLC, for the property located at 34 Commerce Drive, Ivyland, Northampton Township, Bucks County, Pennsylvania, identified as Tax Map Parcel No. 31-1-1-3-4.  The property is improved with a non-residential unit in a larger commercial condominium building, together with common parking areas, drive aisles and related improvements.  The Applicant proposes to conduct a fitness training studio personal services / health club use at the property.  The Applicant seeks variances from and/or interpretations of the following sections of the Northampton Township Zoning Ordinance:  (a) §27-602.1 to conduct the fitness training studio personal services / health club use where such use is not permitted in the I-1 zoning district; and (b) §27-1110.2.A(1) to determine that the off-street parking requirements of the personal services use apply to the Applicant’s proposed use; and to allow less than the minimum required off-street parking spaces for the proposed use, if applicable.

3.         Case No. 2020-13, the application of Raymond Branden, for the property located at 2440 Old Bristol Road, Holland, Northampton Township, Bucks County, Pennsylvania, identified as Tax Map Parcel No. 31-26-50-1.  The property is located in the R-2, Single-Family, zoning district.  The property is improved with a single-family detached dwelling.  The Applicant proposes a fence in the front yard.  The Applicant seeks a variance from Northampton Township Zoning Ordinance §27-406.2.A(4)(a) and §27-1107.1 to permit the new fence to have a 13 feet setback from the curb (3 feet from the property line) along West Bellwood Drive, where the required minimum setback is 60 feet from the curb (50 feet from the property line).

4.         Case No. 2020-14, the application of John and Leslie Kemmerling, for the property located at 52 Gregory Place, Richboro, Northampton Township, Bucks County, Pennsylvania, identified as Tax Map Parcel No. 31-40-82.  The property is located in the R-2, Single-Family, zoning district.  The property is improved with a single-family detached residential dwelling, attached garage and accessory shed.  The Applicants propose an addition to the side of the existing dwelling that will contain an attached garage.  The Applicants seek variances from the following sections of the Northampton Township Zoning Ordinance: (a) §27-406.2.A(4)(b) and §27-1105.2.D. to permit an individual side yard setback of 12 feet 7 inches, where the required minimum side yard setback is 20 feet; and to permit an aggregate of the side yard setbacks of 37 feet 7 inches, where the required minimum aggregate is 45 feet; (b) from §27-1105.2.A to permit the depth of the attached garage to be 38 feet 11 inches, where the maximum depth permitted by right is 32 feet; and (c) from §27-1105.2.C to permit the floor area of the new attached garage to be 1,194 square feet, where the maximum floor area permitted by right is 900 square feet.

5.         Case No. 2020-15, the application of Triumph Development Group, LLC, for the property located at 840 Second Street Pike, Richboro, Northampton Township, Bucks County, Pennsylvania, identified as Tax Map Parcel No. 31-18-4.  The property is located in the C-2, General Commercial/Office, zoning district.  The property is also located in the Village Overlay district.  The property is improved with three (3) non-residential buildings, parking areas and drive aisles.  The Applicant proposes to demolish one non-residential non-conforming building, and renovate and expand the other two (2) non-residential buildings, to conduct professional office uses and six (6) apartment-style dwelling units.  The Applicant seeks a variances from and/or interpretations of the following sections of the Northampton Township Zoning Ordinance: (a) from §27-1110.2.A(1) to allow less than the minimum required off-street parking spaces on the property for the proposed office use and residential uses (31 spaces proposed, when 45 are required); (b) from §27-1125.5.I to permit an impervious surface ratio of 83%, where the maximum impervious surface ratio permitted by right is 70%; and (c) from §27-1206 to permit the building replacing the razed non-conforming structure to maintain the existing dimensional nonconformities.

6.         Case No. 2020-16, the application of Michael Urella, for the property located at 17 Van Dyck Drive, Holland, Northampton Township, Bucks County, Pennsylvania, identified as Tax Map Parcel No. 31-66-89.  The property is located in the R-2, Single-Family, zoning district.  The property is improved with a single-family detached dwelling.  The Applicant proposes a fence and accessory storage shed in the front yard.  The Applicant seeks a variance from the following sections of the Northampton Township Zoning Ordinance:  (a) from §27-406.2.A(4)(a) and §27-1105.5.A to permit the new shed to have a 35 feet setback from the curb (25 feet from the property line) along Meer Drive, where the required minimum setback is 60 feet from the curb (50 feet from the property line); and (b) §27-406.2.A(4)(a) and §27-1107.1 to permit the new fence to have a 10 feet setback from the curb (0 feet from the property line) along Meer Drive, where the required minimum setback is 60 feet from the curb (50 feet from the property line).

7.         Case No. 2020-17, the application of Roman and Valentina Pristatskiy, for the property located at 62 Hill Road, Ivyland, Northampton Township, Bucks County, Pennsylvania, identified as Tax Map Parcel No. 31-49-68.  The property is located in the R-1, Single-Family, zoning district.  The property is improved with a single-family detached dwelling.  The Applicants propose an in-ground pool, pool deck, equipment pad, retaining wall and building addition to enclose the pool improvements.  The Applicants seek variances from the following sections of the Northampton Township Zoning Ordinance:  (a)  §27-405.2.A(3) to permit a building coverage ratio of 18%, where the maximum building coverage ratio permitted by right is 10%; (b) §27-405.2.A(5) to permit an impervious surface ratio of 34.6%, where the maximum impervious surface ratio permitted by right is 20%; and (c) §27-405.2.A(4)(c) to permit the pool enclosure building addition to have a rear yard setback of 12.6 feet, where the required minimum rear yard setback is 50 feet.

The Applicant proposes an inground pool and decking.  The Applicant seeks a variance from Northampton Township Zoning Ordinance §27-903.4.C. to permit an impervious surface ratio of 25.13% instead of the maximum permitted 20%.
